These Terms of Service ("Terms") govern your access to and use of the HabitCore mobile application (the "App"), provided by Ace ("we," "us," or "our").
By creating an account or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.
1. Acceptance of Terms
By accessing or using HabitCore, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Ace.
If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Eligibility
Age Requirement:
- You must be at least 13 years old (or 16 in the European Union) to use HabitCore.
- If you are under 18, you must have permission from a parent or legal guardian to use the App.
Account Requirements:
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must not share your account with others.
- One person may not maintain more than one account.
Prohibited Users:
- We reserve the right to refuse service to anyone for any reason at any time.
- If your account has been previously terminated, you may not create a new account without our permission.
3. Account Registration and Security
Creating an Account:
- You must register with a valid email address and create a secure password.
- You must verify your email address before accessing full app features.
- The information you provide must be accurate, current, and complete.
Account Security:
- You are solely responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized access or security breach.
- We are not liable for any loss or damage arising from your failure to protect your account.
Account Termination by User:
- You may delete your account at any time through the app settings.
- Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
- You will lose access to all data, habits, and community content associated with your account.
4. Acceptable Use Policy
You Agree NOT to:
Prohibited Activities:
- Violate any local, state, national, or international law or regulation
- Infringe upon or violate our intellectual property rights or the rights of others
- Harass, abuse, threaten, or intimidate other users
- Post or transmit spam, unsolicited messages, or advertising
- Upload viruses, malware, or any malicious code
- Attempt to gain unauthorized access to the App or related systems
- Scrape, data mine, or use automated tools to access the App
- Reverse engineer, decompile, or disassemble any part of the App
- Impersonate another person or entity
- Create multiple accounts or use the App for fraudulent purposes
Prohibited Content:
- Content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or hateful
- Content that promotes violence, discrimination, or illegal activities
- Sexually explicit or pornographic content
- Content that infringes on intellectual property rights
- Private information of others without consent (doxxing)
- Misleading or false information
- Content that violates our community guidelines
5. Subscriptions and Payments
Premium Subscription:
- HabitCore offers optional premium features through in-app purchases.
- Subscriptions are billed on a recurring basis (monthly or annually).
- Pricing is displayed in the App and may vary by region.
- All payments are processed through Apple App Store or Google Play Store.
Billing and Auto-Renewal:
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- Your payment method will be charged within 24 hours prior to the start of each renewal period.
- You can manage or cancel your subscription through your device's app store settings.
Refund Policy:
- All purchases are final and non-refundable except as required by law or at our sole discretion.
- If you believe you were charged in error, contact us at Ace.agency921@gmail.com within 14 days.
- Refund requests are subject to the refund policies of Apple App Store or Google Play Store.
- Canceling a subscription does not entitle you to a refund for the current billing period.
6. Intellectual Property Rights
Our Rights:
- HabitCore and all content, features, and functionality are owned by Ace.
- This includes but is not limited to: text, graphics, logos, icons, images, audio, video, software, and code.
- Our trademarks, service marks, and logos may not be used without our prior written consent.
Your Rights:
- You retain all rights to the content you create in the App (habit names, descriptions, notes, community posts).
- By posting content in community features, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App.
7. Data and Privacy
- We collect and use your personal information as described in our Privacy Policy.
- By using the App, you consent to our data practices as outlined in the Privacy Policy.
- Your habits and data are stored on our servers and synced across your devices using Google Firebase.
- You have the right to access, correct, or delete your personal data.
8. Disclaimers and Limitations of Liability
"AS IS" Service:
HabitCore is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee that the App will be always available, uninterrupted, or error-free.
No Medical or Professional Advice:
HabitCore is a habit tracking tool, NOT a substitute for professional advice. We do not provide medical, psychological, financial, or legal advice. Always consult qualified professionals for health, mental health, or other professional matters.
9. Termination
Termination by You:
You may terminate your account at any time by deleting it through the App settings. Upon termination, you will lose access to all features, data, and content.
Termination by Us:
We may suspend or terminate your account immediately, without prior notice, for any reason, including violation of these Terms, fraudulent or illegal activity, extended periods of inactivity, or technical/security reasons.
10. Modifications to the Service and Terms
Changes to the App:
- We reserve the right to modify, suspend, or discontinue any part of the App at any time.
- We may add, remove, or change features without notice.
Changes to Terms:
- We may update these Terms from time to time.
- We will notify you of material changes by posting the updated Terms in the App or sending an in-app notification.
- Continued use of the App after changes constitutes your acceptance of the new Terms.
11. Third-Party Services
- Your use of HabitCore through the Apple App Store or Google Play Store is also subject to their terms and conditions.
- We use Google Firebase for backend services. Your use of the App is subject to Google's Terms of Service and Privacy Policy.
- All in-app purchases are processed by Apple or Google. We do not have access to your payment card information.
12. Governing Law and Dispute Resolution
Governing Law: These Terms shall be governed by and construed in accordance with the laws of Iraq, without regard to its conflict of law provisions.
Informal Resolution: Before filing a claim, you agree to contact us at Ace.agency921@gmail.com to attempt to resolve the dispute informally for at least 30 days.
